Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled 2 SECTION 1. SEC. 2. COPYRIGHT INFRINGEMENT. 1 (a) S TATUTORY D AMAGES A DJUSTMENT .Section 2 504(c)(2) of title 17 United States Code is amended by 3 adding at the end the following: The court shall remit 4 statutory damages for secondary infringement except in 5 a case in which the copyright owner sustains the burden 6 of proving and the court finds that the act or acts consti- 7 tuting such secondary infringement were done under cir- 8 cumstances in which no reasonable person could have be- 9 lieved such conduct to be lawful. 10 (b) C ODIFICATION OF S UPREME C OURT P RECEDENT 11 A PPLICABLE TO H ARDWARE D EVICES .Section 501 of 12 title 17 United States Code is amended by adding at the 13 end the following: 14 (g) C ERTAIN H ARDWARE D EVICES .No person 15 shall be liable for copyright infringement bas ...
