Content Inside: Business Law Case Study Sample 210.01 Kids Just Want to Have Fun! CASE SITUATION You are a consultant for a firm that provides marketing and legal advice to businesses and other organizations in a five state area. One of your clients is T INKER S T OYS a regional company with large discount warehouse-style stores in 3 states. They recently purchased Swingers a manufacturer of playground equipment. Swingers currently manufactures four playground models. Each of the playgrounds is made of treated wood and is held together by bolts and screws. All of the models have a basic clubhouse that is reached by a built-in ladder. Most of the accessories (slides etc.) are accessible from this clubhouse which has wooden sidewalls everywhere EXCEPT where kids need access to the accessories (i.e. going down the slide). All of the models include multiple swings attached to a support beam using rope and metal hooks and at least one plastic slide. The more expensive the model the larger the framework and the more accessories that are included. A climbing wall may be purchased separately as an add-on to any of the four models and various types of swings are also available (from an infant safety-seat to a two-person swing). Depending on the model there are either three or four large boxes that hold all of the equipment accessories screws etc. Add-on accessories come in their own boxes. Each model comes with step-by-step instructions for assembly. On the front of the instructions is a statement stating This product may cause physical injury. Customers are responsible for handling the merchandise after purchase from loading the boxes into their vehicles to assembly at their destination. Although T INKER S T OYS views playground equipment as a logical extension of their product line they are not familiar with issues related to the safe use of the equipment.
